("Bonjour Fête," "we," "us," or "our"). By accessing or using our site or placing an order, you agree to these Terms, our Privacy Policy, and our other posted policies. If you do not agree, please do not use the site.

Please read the "Dispute Resolution" section carefully. It requires most disputes to be resolved by binding arbitration on an individual basis and includes a class-action and jury-trial waiver.

Dispute Resolution, Arbitration, and Class-Action Waiver

Most disputes can be resolved quickly by contacting us at hello@bonjourfete.com. If we cannot resolve a dispute informally, you and Bonjour Fête agree that any dispute arising out of or relating to these Terms or your use of the site will be resolved by final and binding individual arbitration, rather than in court, except that either party may bring a claim in small-claims court.

Class-action and jury-trial waiver. You and Bonjour Fête agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative action. You and Bonjour Fête each waive the right to a trial by jury.

Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing hello@bonjourfete.com with your name and a statement that you wish to opt out of arbitration. Opting out will not affect any other part of these Terms.

Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Subject to the Dispute Resolution section, any claim not subject to arbitration will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

Miscellaneous

These Terms, together with our Privacy Policy and other posted policies, are the entire agreement between you and Bonjour Fête regarding the site. If any provision is found unenforceable, the rest will remain in effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our consent, and we may assign them in connection with a merger, acquisition, or sale of assets.
