The Bonjour Fête mobile message service (the "Service") is operated by Bonjour Fête, Inc. ("Bonjour Fête," "we," "us," or "our"). By enrolling in, using, or otherwise consenting to receive text messages through the Service, you agree to these Mobile Terms and SMS Conditions ("Mobile Terms"), our Terms of Service, and our Privacy Policy. We may modify or cancel the Service, or any of its features, without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time, and your continued use of the Service after the effective date of any change means you accept that change.

Your Consent

By providing your mobile number and opting in to the Service, you consent to receive recurring automated marketing and informational text messages (for example order updates, shipping notifications, cart reminders, back-in-stock alerts, and promotional offers) from or on behalf of Bonjour Fête at the number you provided, including through an automatic telephone dialing system or similar technology. Consent is not a condition of any purchase. You do not have to enroll in the Service to buy anything from us, and your participation is entirely voluntary.

Message frequency varies based on your activity and the programs you join.

Cost

We do not charge a fee for the Service, but message and data rates may apply depending on your mobile plan. You are responsible for any charges from your wireless provider. Check your plan and contact your carrier for details.

How to Opt Out

You can cancel at any time. Reply STOP, END, QUIT, CANCEL, or UNSUBSCRIBE to any message, or use the unsubscribe link where available. We honor opt-out requests made by any reasonable means. After you opt out, we will send one confirmation message, and you will not receive further texts unless you opt back in. If you have joined more than one of our messaging programs, you may need to opt out of each one separately.

Your Mobile Number

You agree to provide a valid mobile number that you are authorized to use. If you change or give up that number, you agree to opt out of the Service first, so messages are not sent to someone who later holds the number. You agree to notify us of any change to your mobile number, and you agree to indemnify us for claims, costs, or damages arising from your failure to do so, including claims under the Telephone Consumer Protection Act.

Delivery

Mobile carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and network, which are outside our control. To the extent permitted by applicable law, we are not responsible for failed, delayed, or misdirected delivery of any message, for any errors in any message, or for any action you take or do not take in reliance on a message or the Service.

Changes to a Short Code or Number

We may change the short code or telephone number we use to operate the Service at any time and will notify you of the change. You acknowledge that any message, including a STOP or HELP request, sent to a short code or number we have changed may not be received, and we are not responsible for honoring requests sent to a retired short code or number.

Eligibility

To use the Service, you must be a resident of the United States and at least 13 years old.

Dispute Resolution

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

To the fullest extent permitted by law, you and Bonjour Fête each waive the right to bring or participate in a class or collective action relating to the Service, and each waive the right to a trial by jury. All claims relating to the Service must be brought in an individual capacity.

Governing Law

These Mobile Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
